Maryland Online Data Privacy Act (MODPA)(1)
The Maryland Online Data Privacy Act, Md. Code, Com. Law §§ 14-4601–14-4614, took effect October 1, 2025. It applies only to certain businesses that, during the prior calendar year, controlled or processed the personal data of at least 35,000 consumers (excluding personal data processed solely to complete a payment transaction), or at least 10,000 consumers while deriving more than 20% of gross revenue from the sale of personal data.
To the best of my knowledge, this Website does not currently meet those thresholds. Nothing in this policy creates contractual rights or obligations under MODPA where MODPA would not otherwise apply.
Maryland Consumer Protection Act(4)
I comply with the Maryland Consumer Protection Act in connection with any commercial offer, sale, or representation I make through this Website, consistent with Md. Code, Com. Law §§ 13-301 and 13-303. This statement covers commercial transactions or offers I make through the Website and does not characterize or limit the legal status of independent journalistic, editorial, or expressive content.
Data Security & Breach Notification
I implement reasonable technical and organizational measures to protect your personal information against unauthorized access, disclosure, alteration, or destruction. No method of transmission over the internet or method of electronic storage is completely secure.
If a security incident involves "personal information" as Maryland's Personal Information Protection Act defines it(2)(3), I will provide all notices applicable law requires - including notice to the Maryland Office of the Attorney General before I notify affected Maryland individuals, and notice to affected individuals as soon as reasonably practicable and no later than 45 days after I discover or receive notification of the breach - unless a statutory delay applies.
I operate this Website in compliance with applicable federal electronic communications privacy laws, including, where applicable, the federal Wiretap Act(5) and Stored Communications Act(6), 18 U.S.C. §§ 2510–2523 and 2701–2712.
